Response: | Please find the following in response to your request. 1. Confirmation of the zoning for the site: Zoning = Rural1 2. Planning rules regarding the site - particularly in relation to the zone, objectives, policies, rules, standard and the rules relating to noise and dust emissions. Relevant planning rules - GRUZ-O2 To maintain and where appropriate enhance the rural character and amenity of the District's rural areas, which includes:
- GRUZ-O2.1 A predominance of primary production and other rural activities.
- GRUZ-O2.2 A landscape within which the natural environment (including farming and forestry landscapes) predominates over the built one.
- GRUZ-O3 To ensure that rural dwellings and properties enjoy a level of rural amenity consistent with the presence of primary production and other rural activities in the zone (Refer also GEN-O5).
- GRUZ-O4 To minimise conflict between potentially incompatible activities in the rural zone, for example between rural houses and activities such as primary production and rural industries (Refer also GEN-O1, GEN-O2).
- GRUZ-P1 To avoid damage to the soil resource from land uses which might result in chemical contamination, excavation, erosion or soil compaction.
- GRUZ-P6 To ensure that new and existing development does not adversely affect the existing character and amenity of the General Rural Zones
- GRUZ-P11 To recognise that rural residents will need to accept that some adverse effects may result from normal primary production and other rural activities from time to time.
- RUZ-P14 To ensure that the presence of existing land uses and their right to continue is recognised by those who purchase or use land within the area affected by those land uses.

- Standards and rules relating to noise and dust emissions
GRUZ-ST11 Noise - Compliance with standards NOISE-ST1 – NOISE-ST4 - NOISE-ST1 Noise levels shall be measured in accordance with NZS 6801:2008 Measurement of Environmental Sound and assessed in accordance with NZS 6802:2008 Acoustics – Environmental Noise unless otherwise specified.
- NOISE-ST2 All activities must comply with the following noise levels for the zone the activity is located in. Refer to Table 5 – Noise Level
- NOISE-ST4 Noise from the following activities are not controlled by NOISE-ST2 in this Plan:
- NOISE-ST4.4 Rural production activities, except for intensive farming.
The activity on the property is a rural production activity therefore it is exempt from having to follow specific noise level rules as laid out according to NOISE-ST2. Section 16 of the RMA - Duty to avoid unreasonable noise - Every occupier of land (including any premises and any coastal marine area), and every person carrying out an activity in, on, or under a water body or the coastal marine area, shall adopt the best practicable option to ensure that the emission of noise from that land or water does not exceed a reasonable level.
- A national environmental standard, plan, or resource consent made or granted for the purposes of any of sections 9, 12, 13, 14, 15, 15A, and 15B may prescribe noise emission standards, and is not limited in its ability to do so by subsection (1).
3. Information on any resource consents that have been obtained for the site Past resource consent information A controlled land use consent (LC7716) was granted on 26 August 2010 to relocate a shed from 774 Kimbolton Road, Feilding onto a property situated at Bell Road West, Feilding.
